These Terms of Service (“Terms”) govern your access to and use of TeamsOnGo, the recruiting platform operated by Sprintflux Technologies Pvt. Ltd. (“Sprintflux Technologies”, “we”, “us”). By creating an account or using the platform, you agree to these Terms.
1. Definitions
- “Customer” means the legal entity subscribing to the Services.
- “User” means an individual authorised by a Customer to access the Services.
- “Recruiter” means an independent professional onboarded to deliver recruitment services on the platform.
- “Candidate Data” means personal data of candidates that flows through the Services.
2. Eligibility & Accounts
You must be at least 18 years of age and authorised to enter into contracts on behalf of any organisation you represent. You are responsible for safeguarding your credentials and all activity under your account.
3. Subscription, Pricing & Payment
- Plan prices are agreed in your subscription proposal and are exclusive of GST. 18% GST is added at checkout in line with applicable Indian tax law.
- Payments are processed by Razorpay Software Pvt. Ltd. We do not store card details.
- Subscriptions auto-renew at the end of each billing cycle unless cancelled. Renewal pricing is at the then-current published rate.
- We may suspend access for non-payment after a 7-day grace period. Continued non-payment for 30 days may result in account termination.
4. Refunds & Cancellation
See our Refund & Cancellation Policy. In summary: 14-day money-back guarantee on first subscription; pro-rata refunds on plan downgrades; no refunds on partial months after the trial window.
5. Acceptable Use
You agree not to (a) misuse Candidate Data; (b) attempt to circumvent or remove Recruiters from the platform to avoid fees; (c) reverse-engineer, scrape, or replicate the Services; (d) upload malware, illegal content, or content infringing third-party rights; (e) use the Services for unlawful discrimination.
6. Intellectual Property
The Services, including all software, designs, trademarks (“TeamsOnGo”) and content, are owned by Sprintflux Technologies Pvt. Ltd.. You retain ownership of your data. You grant us a limited licence to use your data solely to operate, secure and improve the Services.
7. Recruiter Engagement & Non-Circumvention
Recruiters are independent contractors, not employees of Sprintflux Technologies. Customers agree not to engage Recruiters introduced via the platform off-platform for the duration of the subscription and 12 months thereafter.
8. Replacement Guarantee
Plan-specific replacement guarantees apply only when (a) the Customer reports the departure within 14 days of the hire's exit, (b) all prior invoices are settled, and (c) the role definition has not materially changed.
9. Service Levels
We target 99.9% monthly uptime (99.95% for ScaleHire and Enterprise). Scheduled maintenance is excluded. Service credits, where applicable, are stated in your Order Form.
10. Confidentiality
Each party agrees to hold the other's confidential information in strict confidence and use it only to perform under these Terms.
11. Data Protection
Both parties shall comply with applicable laws including the Digital Personal Data Protection Act, 2023 (India), GDPR (where applicable), and the IT Act, 2000. See our Privacy Policy and Data Processing Addendum.
12. Indemnification
Each party agrees to indemnify the other against third-party claims arising from breach of these Terms, infringement of IP, or violation of law.
13. Limitation of Liability
To the maximum extent permitted by law, neither party's aggregate liability shall exceed the fees paid by the Customer in the 12 months preceding the event giving rise to liability. Neither party is liable for indirect, incidental or consequential damages.
14. Suspension & Termination
We may suspend or terminate access for material breach (uncured 30-day notice), illegal use, security risk, or non-payment. Upon termination you may export your data within 30 days; thereafter we may delete it.
15. Changes to the Terms
We may update these Terms with at least 15 days' notice for material changes. Continued use after the effective date constitutes acceptance.
16. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra.
